A credit card is required in order to register for this auction. An authorization charge of $1,000.00 will be charged against the credit card used for registration. This authorization is not a permanent charge. Thus, pre-authorization is used to verify the identity of our bidders and the availability of funds on the credit card used for registration. Brewer Land Auctions reserve the right to accept or reject bidder registration at its sole discretion. The identity of all bidders will be verified, bidding privileges are provisional, and if complete verification is not possible Brewer Land Auctions LLC reserves the right to reject the registration, and bidding activity is subject to termination. Brewer Land Auctions LLC has the sole authority to resolve any bidding disputes as they arise.

The auction is scheduled to end at the advertised end time. Brewer Land Auctions utilizes an auto extend bidding. Each time a bid is placed within 5 minutes of the end time the clock will reset to 5 minutes. Brewer Land Auctions reserves the right to adjust the auto extend as necessary.
Buyer’s Premium:
A 10% Buyers Premium will be added to the final bid price to determine the final contract price.

Contract For Sale:

As is Where Is:
All property is selling “as-is, where is”. It is the buyer’s responsibility to conduct all inspections prior to bidding.
Bidder Default:
In the event winning bidder fails to submit the signed Contract for Sale and earnest money deposit as provided in the terms, the winning bidder will be charged an administrative fee of $2,500.00 on the credit card provided at registration.
All administrative fees are non-refundable.
Earnest Money Deposit:
The winning high bidder will be required to submit the earnest money as stipulated in the Contract for Sale. The earnest money deposit will be 15% of the final contract price.
The winning high bidder will have 24 hours to send earnest money in the form of Cashier’s Check or Wire transfer.
Contracts:
Contract packages will be sent by email to the successful high bidder at the conclusion of the auction. Successful high bidder must execute and fax, email or hand deliver the package back to Brewer Land Auctions within 24 hours of receipt. Successful high bidder not executing and return their contract with earnest money deposit within 24 hours of receipt will be considered in default and subject to an administrative fee.
Closing:
The final contract will be a cash contract. The winning bidder will be responsible for all closing cost associated with the closing. The contract will NOT be subject to financing, survey, or appraisal. The closing date will be on or before December 18, 2023. If the closing is delayed for any reason, by you, as purchaser, or other parties working on your behalf, including any lender you provide-you may be declared in breach of the contract, forfeit all deposits made, and could be additionally liable for any and all cost incurred by the seller and Brewer Land Auctions LLC in a subsequent resale of the property.
Agency Disclosure:
Brewer Land Auctions is acting as an agent for the seller and at no time as a buyer’s agent. Brewer Land Auctions reserves the right to remove, cancel bids, bidding rights, that are determined not to be in the best interest of the seller. At auctions with reserve, the seller and/or auctioneer reserves the right to bid on the Seller’s behalf. On all auctions, auctioneer reserves the right to bid on auctioneer’s behalf when permitted by law.

system, or (iii) otherwise. Auctioneer may, but will not be required to, continue, suspend, delay,
extend, reschedule, or close the Auction because of disruptions caused by technology failures,
even after bidding has commenced.
Failures by Online Auction Platform Provider and its Affiliates or Contractors:
Auctioneer may use an Online Auction Platform Provider to facilitate the Auction. Under no
circumstances will Auctioneer be liable for any failure of the Online Auction Platform Provider
to perform all or any of its obligations, or for the failure of any affiliates, employees, agents,
representatives, or contractors of the Online Auction Platform Provider to perform their
obligations.
Disclosure:
As detailed in Rule 55-10-.01(3) of the Georgia Auctioneers Commission: Any auctions sale is without requirement of announcement at any time, presumed to be with reserve unless the property are in explicit terms put up at absolute auction.
